Privacy Policy

Introduction

This policy covers the iOS app, its iMessage extension, the judge web page and this website. It explains what Betcha Jalapeño ("we," "our," or "us"), a product of Marshland Software LLC, collects from you and what we do with it. Betcha Jalapeño is a peer-to-peer betting app for friends. Bets are staked in pods, an in-app score with no cash value. We never take a payment and never hold money for anyone.

1. What we collect

Account. Your email address and a password (stored only as a hash by our sign-in provider, Amazon Cognito), a display name and username, and, if you add them, a phone number and a profile photo. We send a one-time code to your email to confirm the account.

Bets and what happens in them. The bets you send, receive, counter, accept or decline; the stake, deadline and outcome; notes, taunts and photos you post in a bet; the side you call at settlement; and, in a dispute, the statement and photos you submit. We also keep your pod balance and a ledger of every change to it, your friends list, and which bets you have muted.

Judges. When a dispute goes to a judge, the judge sees both sides' statements and photos. If you nominate someone who is not on Betcha, the name and the phone number or email you type for them is shown to the other side so they know who they are agreeing to, and is used to build the link you send. That person reads the case on the web without an account.

Contacts, only if you allow it. To find friends already on Betcha, the app can read your contacts. Phone numbers are hashed on your phone before anything is sent, and we match those hashes against members' own hashed numbers. We do not receive your contacts' names or raw numbers, and we do not message anyone for you. Invites to people who are not on Betcha are sent from your own Messages app.

Device and diagnostics. IP address, device model, OS version, app version, a push notification token, and crash and error reports, used to keep the app secure and working.

Product analytics. We may use a product-analytics service to see how features are used, keyed to your account. This can include session recordings inside the app in which text you type is masked. We do not use it for advertising and do not share it with advertisers.

Invite attribution. When you open an invite or judge link on a phone without the app, the page records the code with four device signals (OS major version, screen size, timezone and language) so the app can credit the right invite after install. The record is kept only long enough to do that. We do not use it to build an advertising profile.

This website. It uses Google Analytics to count visits, and Google reCAPTCHA on the email form to keep bots out; both are governed by Google's privacy policy. If you give us an email for updates, we keep it for that and nothing else.

2. How we use it

• To run the app: creating, settling and disputing bets, keeping pod balances, finding friends, sending notifications you have turned on, and crediting invites.
• To keep accounts secure and stop abuse, fraud and automated access.
• To send transactional email: sign-in codes, password resets and account notices. We do not send marketing email without your consent.
• To fix bugs and understand which features get used.

3. What we don't do

We never sell your personal information. We do not share it with advertising partners or data brokers, and we show no ads. Pods are an in-app score, not a currency or a financial instrument, and nothing in this policy creates a right to redeem them for money.

4. Who sees your data

Other people in a bet. A bet, its posts and its outcome are visible to its two participants, and to a judge if one is called in. Your display name, username, profile photo and head-to-head record are visible to your friends.

Providers who run the service for us. Amazon Web Services (hosting, storage, sign-in and email delivery), Apple (push notifications and the App Store), Google (reCAPTCHA and Google Analytics on this website), and our product-analytics provider. Each is limited to running the service.

When the law requires it, or to protect the safety and integrity of the service and its users.

5. Retention and deletion

We keep your account and bet history while your account is active, so your record with your friends stays intact.

You can delete your account yourself in the app under Settings. That removes your sign-in and profile right away. Bets you settled with other people stay in their history, and copies in backups roll off on their own schedule. We keep what the law or a security investigation requires us to keep. You can also ask us by email to delete your account, using the address below.

6. Your choices

• Contacts, camera, photos and notifications are iOS permissions. You can grant or revoke each one in the Settings app at any time; the app works without them.
• You can mute any bet to stop its notifications.
• You can ask us for a copy of your data, or to correct or delete it, by email. If you are in a jurisdiction with statutory privacy rights (such as the EU/UK GDPR or the California CPRA), you may also object to or restrict certain processing; write to us and we will respond.

7. Security and where your data lives

Data travels over TLS and is stored on Amazon Web Services in the United States. Passwords are held only as hashes by Amazon Cognito. We never collect payment details, because there is nothing to pay for.

Betcha Jalapeño is run from the United States. Wherever you use it from, your data is stored and processed there, and by using the app you agree to that.

8. Children

Betcha Jalapeño is not directed at children under 13, and we do not knowingly collect data from them. Our Terms of Service require users to be 18 or older. If you believe a child has created an account, contact us and we will remove it.

9. Changes to this policy

We will update the effective date above when this policy changes and, for material changes, tell you in the app or by email.
