Terms of Service

1. The service

Betcha Jalapeño, made by Marshland Software LLC, lets you bet your friends on anything you can put in a sentence, staked in pods. Pods are an in-app score with no cash value. There is no real-money wagering, no house, no odds and no prizes. The only thing at stake is the record between you and your friends. By creating an account or using the app, its iMessage extension, the judge web page or this website, you agree to these terms.

2. Who can use it

You must be at least 18 years old. By using Betcha Jalapeño you represent that you are 18 or older, and that using it is legal where you live.

3. Your account

Registration is free and takes an email address and a password. We email you a one-time code to confirm the address. Adding a phone number is optional and is only used to help friends find you. Keep your password to yourself: you are responsible for everything done through your account. One account per person.

4. Pods

  • You get pods free when you sign up and a free deposit each day you open the app. The daily deposit grows with an unbroken streak, up to five times the base amount, and resets when the streak breaks.
  • When a bet is accepted, both stakes are held until it settles. The winner takes the pot.
  • Calling in a judge costs each side a fee of ten percent of the stake, which the judge keeps. A bet that both sides let wash returns both stakes with no fee.
  • Pods cannot be bought, sold, transferred, gifted, cashed out or exchanged for anything of value, inside or outside the app. We may adjust balances to correct an error or undo abuse, and we may change how pods are earned at any time.

5. Bets and settlement

A bet is between two people. The person challenged may accept, counter the stake or decline. When a bet reaches its deadline, both sides call the result. If you both agree, it settles. Either side can concede at any time, which settles the bet in the other side's favor. If one side calls it and the other does not respond within 24 hours, the bet settles on the call that was made. If you disagree, the bet goes to a dispute round where you can each hold your position, agree to wash it, or call in a judge.

Every bet is voluntary and for entertainment. You are responsible for the wording of the bets you send and for settling them honestly.

6. Judges

A judge is a mutual friend on Betcha, or, when there is nobody in common, someone outside Betcha you invite by link. Both sides have to agree to the judge before they see the case. Refusing every judge forfeits the bet. The judge reads both statements and any photos, rules once, and the ruling is final. An outside judge rules on the web without an account and agrees to these terms by doing so; their fee is held for them until they create an account. A judge may never hold a claim in the bet they rule on.

7. Your content

You own the bets, notes, taunts, photos and statements you post. You give us a license to store them and show them to the people in the bet and to any judge, for as long as the bet exists. You agree not to:

  • make bets about illegal activity, or that would harm anyone if carried out;
  • post content that is unlawful, hateful, harassing, threatening, defamatory, obscene or that you do not have the right to share, including photos of people who have not agreed to be posted;
  • use taunts or posts to harass someone who has asked you to stop;
  • impersonate anyone, run more than one account, or access the service by automated means without our permission.

We may remove content or suspend an account that breaks these rules.

8. Contacts and invites

If you allow the app to read your contacts, phone numbers are hashed on your phone before they are used to find friends already on Betcha. Invites to people not on Betcha are sent from your own Messages app, and you are responsible for the messages you send. Bets sent through the iMessage extension are also subject to Apple's terms for Messages.

9. Intellectual property

Betcha Jalapeño, its name, mascot, design and code belong to Marshland Software LLC and are protected by intellectual property law. You may share cards and records the app makes for you for personal, noncommercial purposes.

10. Ending your account

You can delete your account at any time in the app under Settings, or by emailing us. We may suspend or terminate an account that violates these terms, and will tell you by email when we do. Pods have no value, so nothing is owed on termination and any balance is forfeited.

11. Disclaimers and limitation of liability

Betcha Jalapeño is provided "as is" and "as available." We make no guarantees about uptime, about who wins, or about how a judge rules. To the fullest extent permitted by law, Marshland Software LLC is not liable for any indirect, incidental, special or consequential damages arising from your use of the service, and our total liability to you for any claim is limited to one hundred US dollars.

12. Changes

We may change the service, the pod economy or these terms at any time. For material changes to the terms we will update the effective date above and tell you in the app or by email. Continuing to use the service after a change means you accept it.

13. Governing law and disputes with us

These terms are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-law rules. Any dispute with us that we cannot resolve informally will be settled by binding arbitration in Arizona on an individual basis, and you waive any right to bring or join a class action.

14. Privacy

Our Privacy Policy explains what we collect and why, and is part of these terms.

15. Entire agreement

These terms and the Privacy Policy are the whole agreement between you and Marshland Software LLC about Betcha Jalapeño. If any part is held invalid, the rest stays in effect.
